Unfair dismissal arises where you were dismissed without a valid reason or your employer did not follow correct protocol or dismissed you in an unreasonable way.

Constructive dismissal occurs if you resign from your position due to your employer breaching a term of your contract, therefore making it impossible for you to continue working for them.

·You must have been working for your employer for a minimum of 12 months

·You must be below the average retirement age of 65 years old

·Your claim to the Employment Tribunal must be within 3 months of your dismissal
